What is bought and ordered online today as "snus" – tobacco-free nicotine pouches – is completely legal in Germany. Classic tobacco snus, however, may not be sold in Germany. The difference lies in the tobacco content.
The term "snus" is used today for two different products. In common parlance and in online shops, "snus" almost always refers to tobacco-free nicotine pouches – this is the product that can be legally ordered. The original Swedish snus contains tobacco and may not be sold in Germany. This article explains the difference and the exact legal situation for both.

What Does "Snus" Mean Today?
Originally, snus refers to a Swedish tobacco product: finely ground, moist tobacco in small pouches, placed under the upper lip. This product contains tobacco and is not for sale in Germany (as in almost all EU countries).
In recent years, the meaning of the term has shifted. What is offered today in German online shops as "buy snus" are almost exclusively tobacco-free nicotine pouches. These contain no tobacco – the nicotine is extracted from nicotine salts and embedded in plant fibers. Consumers still call them "snus" because the application is identical: placed under the lip, nicotine is absorbed through the oral mucous membrane.

Why is Tobacco Snus Forbidden in Germany?
The EU Tobacco Products Directive (2014/40/EU), Article 17, prohibits the placing on the market of "tobacco for oral use" in all EU Member States. Sweden is exempt as a historical exception. Germany has implemented this prohibition in the Tobacco Products Act (TabakerzG).
The sales ban exclusively concerns trade. The possession or consumption of tobacco snus for personal use is not punishable in Germany. Many users therefore import small quantities from Sweden or Norway.
Legal Situation for Tobacco-Free Snus in Germany
Tobacco-free nicotine pouches – what is meant today by "buy snus" – are legal in Germany. Since they contain no tobacco, they do not fall under the EU sales ban. The sale is subject to the following requirements:

Will Snus Ever Be Fully Legalized in Germany?
Legalization of tobacco snus in Germany is not to be expected in the short term – Germany is bound by the EU Tobacco Products Directive. Changes would only be possible at EU level. Sweden has had its exemption since joining the EU in 1995 and is considered a special case.
What is evolving, however, is the regulation of tobacco-free snus. Several EU countries are discussing uniform standards for maximum nicotine levels, packaging regulations, and age verification. An EU-wide regulation is expected – but it would concern the framework conditions for legal products, not the prohibition.
